I haven’t read Judge Leon’s opinion regarding the constitutionality of the National Security Agency’s collection of meta data, but if Paul Rosenzweig is on the money, I guess that I shouldn’t be too impressed with the opinion. I would also be more willing than is Rosenzweig to bet that the decision will be overturned, but then, I guess that has to do with my potentially naïve belief that appellate courts won’t put up with (a) trial courts dispensing with precedent merely because cases aren’t young, or (b) trial courts trying to pretend that concurring opinions have precedential value.
